Sexual Harassment

Rockville, Maryland, Sexual Harassment Attorney

In the past, many people thought of sexual harassment as a supervisor asking for sexual favors as a condition for a job consideration. However, harassment can take many forms. It often has less to do with sex and more to do with intimidation.

At Farber Legal in Rockville/North Bethesda, Maryland, our lawyer represent employees and employers in sexual discrimination cases throughout Maryland and the Washington, D.C., area. Our lawyer can advise you whether you have a sexual harassment case and guide you through the steps to protect your rights. We offer an initial consultation to discuss your case at a discounted fee.

Sexual harassment can include unwelcome sexual advances, requests for sexual favors, or sexual comments or actions that create a hostile work environment. To quality as sexual harassment, the behavior can’t be an isolated or one-time incident. The behavior or actions must be repeated. In addition, you must notify your company's human resources department. If you don't, your employer may have a good defense since it can claim it didn't know about it.

If your employer makes any threats or retaliates against you for reporting the behavior, you may have an additional lawsuit against your employer for retaliation.

Sexual harassment and discrimination

Generally, Title VII of the Civil Rights Act of 1964 prohibits discrimination in private employment and government employment. It is unlawful for a private employer, a government employer, an employment agency, or unions to engage in discriminatory employment practices. Such discriminatory practices include refusal to hire qualified individuals, discharging an employee, or affecting an individual's working conditions on the basis of sex, race, national origin, or religion.

Under Title VII, one form of sex discrimination is sexual harassment. Sexual harassment laws fully protect male employees as well as female employees. Sexual harassment is also prohibited by Title VII when the harasser and victim are of the same sex.
